Discussion

88 S. Broadway Association vs. 88 S. Broadway, LLC This lawsuit involved a multi-story mixed-use residential and commercial project located at 88 South Broadway in Millbrae, California. Bragg Crane signed a contract with Taisei Construction Corporation to lift steel at the construction site of the project. Bragg was one of many subcontractors named by Taisei in its cross-complaint. Gray•Duffy took an aggressive posture at the outset of the case based on an argument that Bragg’s work at the project site did not cause any of the alleged damages. After several months, the case settled with Bragg receiving a dismissal in conjunction with the settlement, without having to contribute any money to the settlement. Thus, Gray•Duffy was able to extricate Bragg from litigation without ever making a formal appearance in the case.
