Patrick Roberts of Gray•Duffy negotiated and achieved a settlement in the amount of $7,000 for claims against the firm’s roofing subcontractor client in a construction defect lawsuit.

Discussion

Charles and Sheila Newsome v. U.S. Home Corporation The construction defect lawsuit involved 12 residences in a project known as Volterra at Tuscan Hills in Lake Elsinore, California. The plaintiffs alleged various defects and damages to their homes as a result of the construction. The developers, who cross-complained against all of their subcontractors, originally provided a settlement demand to the roofing subcontractor in excess of $149,000. After the developer’s initial demand, numerous mediation hearings took place. After substantial negotiation involving the mediator and documenting the client’s scope of work and lack of any significant roofing related defects, Mr. Roberts was able to obtain an agreement to resolve the roofing claims for a settlement in the amount of $7,000.
