John Duffy and Michael Eisenbaum Present on Process of Lawsuits and Discovery to Wells Fargo

Partners John Duffy and Michael Eisenbaum presented to Wells Fargo Insurance Services on the process of lawsuits and discovery on February 13, 2014. The presentation was a huge success and was widely attended. For the sake of reference, eDiscovery (electronic discovery) refers to the legal process of discovering electronic data that is potentially relevant to litigation. As time has passed eDiscovery has moved more into the mainstream of the legal field. Attorneys have a duty to best represent the interests of their clients, which now means gathering all the relevant information and knowing the requirements. Their presentation covered topics, including the service of a lawsuit, the insurance company’s response, duty to preserve evidence before discovery is undertaken, electronically stored information (ESI), ediscovery tools, and the process of discovery. Mr. Duffy and Mr. Eisenbaum discussed legislative updates pertaining to ESI trending toward preservation of information and suspending any data deletion policies. Further, they discussed how discovery is allowed unless limited by a court order, and includes interrogatories, depositions and demand for inspection of documents.
