Everest National Insurance v. Continental Manufacturing Gray•Duffy’s client, Continental Manufacturing, manufactured and distributed a commercial trash container and platform roller for the container which was allegedly defective and caused serious injury to an employee working for an insured of Everest National Insurance Company. The employee sustained severe back injuries, requiring numerous surgeries and resulting in near permanent disability and inability to work. Because of a worker’s compensation lien in excess of $500,000, the worker’s compensation carrier, Everest National Insurance, filed a strict products liability subrogation claim against Continental Manufacturing. After protracted negotiations, the subrogation lawsuit, filed in Orange County Superior Court, was settled for $5,000.
