Gray•Duffy, LLP Obtains Complete Dismissal of Roofing Subcontractor Client in Construction Defect Lawsuit

Patrick Roberts of Gray•Duffy’s Encino office successfully defended a roofing subcontractor in a construction defect lawsuit involving 71 single-family homes located in Indio, California. It was alleged that the roofing subcontractor’s work was defective, and the developer asserted a settlement demand in the amount of $130,777.

Discussion

Araw v. Century Crowell, et al. In this construction defect lawsuit where multiple parties were involved, a developer sued the firm’s roofing subcontractor client based upon the plaintiffs’ allegations, which included various roof-related defect issues. After conducting investigation and discovery, Mr. Roberts asserted there was no liability on the part of the roofing subcontractor, and thereafter reached an agreement where the firm’s client would be dismissed. The entire case has now been settled, with no contribution to the settlement being made by the roofing subcontractor.
